Terms of Service

Welcome to Scriptio. These Terms of Service ('Terms') form a contract between you (the 'User') and the Publisher of the Application, Jérémie Sidler (the 'Publisher'), governing the use of the Scriptio mobile application (the 'Application') and associated services.

By creating an account or using the Application, you acknowledge having read, understood and accepted in full these Terms as well as the Privacy Policy. If you do not accept all or part of these Terms, you must not use the Application.

Reading the Bible is possible without creating an account; all other features require acceptance of these Terms.

IMPORTANT — These Terms contain several clauses essential to your understanding, in particular regarding: deletion of your account (§ 14), moderation and the Publisher's liability (§ 7 and § 13), applicable law and jurisdiction (§ 15), and subsequent modifications (§ 16).

1. About the Application

1.1 Description of the service

Scriptio is a free Catholic mobile application allowing you to:

Read the Bible in one of several public-domain translations, with free translation switching in Settings (the list of translations offered is set out in the Legal notice, § 6.2)
Annotate biblical verses with text notes or voice notes, in thirteen annotation types (commentary, teaching, meditation, prayer, etc.)
Scan printed text with the camera, using character recognition performed locally on your device, to reuse it in an annotation
Highlight verses in five colours
Organise your annotations in personal collections
Share your annotations with your friends or with the community publicly, according to the visibility settings you choose
Follow verified profiles belonging to the clergy, consecrated life or theological teaching
Interact with the community through friend, subscription and Amen features

The Application is multilingual (French, English, Spanish, Italian, Portuguese, German and Polish) and accessible offline for Bible reading and viewing your annotations.

The Publisher's legal status may evolve (association, company, foundation) as the project develops. Any substantial evolution will be communicated to Users.

1.3 Legal representative in the European Union

In accordance with Article 13 of Regulation (EU) 2022/2065 (DSA), a legal representative for the European Union will be appointed prior to the availability of the Application on European application stores, as a contact point for authorities and Users residing in the European Union. The contact details will be published in this section as soon as the appointment is effective.

1.4 Single point of contact (DSA)

In accordance with Article 11 of the DSA, the single point of contact for authorities and Users can be reached at scriptioorg@gmail.com. Accepted languages are French, English, Spanish, Italian, Portuguese, German and Polish.

1.5 Micro-enterprise status

In his capacity as an independent natural-person publisher, with no employees, and as the Application is offered free of charge with no turnover generated, the Publisher considers himself to fall under the micro-enterprise exemption within the meaning of Article 19 DSA and Article 2 of Recommendation 2003/361/EC on the definition of micro, small and medium-sized enterprises.

As a result, certain obligations specific to large platforms (detailed transparency reports, trusted flaggers, structured internal complaint mechanism, out-of-court dispute resolution, etc.) do not apply. The common DSA obligations (point of contact, clear Terms, transparent moderation, notice-and-action mechanism, statement of reasons for moderation decisions) are fully complied with.

2. Access to the service

2.1 Free of charge

The Application is entirely free. No in-app purchase is offered. No feature is conditional on payment.

No advertising is displayed in the Application. No data is processed for advertising or commercial profiling purposes.

2.2 Free reading of the Bible

Reading of the biblical text is accessible without account creation, in an anonymous mode of the Application. No personal data is collected in this consultation mode, with the exception of technical data strictly necessary for the Application to function (local display preferences).

2.3 Social features

Use of the social features (public or friend-shared annotations, friendship requests, subscriptions, Amens, reports) requires the creation of an account and acceptance of these Terms.

2.4 Availability

The Application is designed to operate on iOS and Android systems according to the minimum versions and configurations indicated on the App Store and Google Play listings. The Publisher endeavours to ensure maximum service availability, without however guaranteeing uninterrupted availability. Interruptions may occur due to maintenance, updates, or events beyond his control (provider outage, force majeure, cybersecurity event).

3. Eligibility

To create an account on Scriptio, you must:

Be at least 13 years old
If you reside in an EU Member State and are under 16 years old, have obtained the prior consent of one of your legal representatives (the applicable age is the one defined by the law of your country of residence — see Privacy Policy, § 9)
Provide accurate, up-to-date and complete information at registration and during use of the Application
Undertake not to create multiple simultaneous accounts to circumvent a suspension, a sanction, or to impersonate an identity
Be responsible for the confidentiality of your login credentials and any activity carried out from your account
Accept these Terms and the Privacy Policy

Any account created in violation of these conditions may be deleted without notice.

4. Account creation and management

4.1 Registration

Registration is done by providing a valid email address and a password meeting the security rules displayed. The authentication service is provided by our technical provider Supabase. You may also create your account and sign in with Apple or Google, without a password (see Privacy Policy, § 2 and § 4).

During onboarding, you choose:

Your membership category (faithful, clergy, consecrated life, theologian)
Optionally, a more specific role (priest, religious, seminarian, etc.)
A profile picture (optional)
Your interface language and local preferences

4.2 Membership category — sensitive data

Your membership category constitutes sensitive personal data within the meaning of Article 9 GDPR. It is processed exclusively on the basis of your explicit consent, collected through a clear and positive affirmative act distinct from the acceptance of these Terms. You may change this choice at any time from Profile › Edit profile › My faith profile; withdrawing it entirely means deleting your account (§ 14). See Privacy Policy, § 2.3.

4.3 Profile modification

You can modify your profile information (name, picture, biography, city, etc.) at any time from the Application.

4.4 Suspension by the Publisher

The Publisher reserves the right to suspend your account on a precautionary basis upon a credible report of a serious violation of these Terms, pending investigation of the report. Suspension is notified by email and gives rise to a swift examination (see § 7).

5. Verification of clergy and consecrated life

5.1 Voluntary procedure

If you declare yourself to be clergy, consecrated life or a theologian, you may apply for verification of this status. This procedure is voluntary and confers on your profile a golden badge indicating your verified status to the community.

Verification is in no way mandatory to use the Application. You may participate in the community without a badge.

5.2 Verification paths

Verification may be carried out by one of the following means:

Upload of an official document (letter of obedience, diocesan attestation, theology diploma, religious-engagement certificate, etc.)
Institutional email from a recognised domain (diocese, congregation, listed Catholic institution)
Sponsorship by an already-verified account

5.3 Decision of the Publisher

The Publisher evaluates each request within a reasonable time, generally 7 working days from receipt of the complete file. The Publisher may accept or refuse a request without having to justify his decision in detail. However, in case of refusal, you may submit a new request accompanied by additional evidence.

Any false declaration or falsified document results in immediate refusal of the request, suspension of the account, and, in case of characterised fraud, its definitive deletion.

5.4 Verification data

Documents submitted for verification constitute sensitive data. Their processing, security and retention periods are described in section 2.4 of the Privacy Policy.

5.5 Badge revocation

The Publisher reserves the right to withdraw the verified badge at any time in case of serious breach of these Terms, conduct contrary to the Catholic mission of the Application, or if the capacity justifying verification has ceased.

6. Rules of conduct and user content

6.1 Spirit of the community

Scriptio is a Christian community of Catholic inspiration. We expect from each User:

Respect for others, in particular members of the clergy, consecrated life and the faithful in the diversity of their sensibilities
A spirit of charity in exchanges, even in cases of doctrinal disagreement
Honesty in the declaration of one's status and identity
Discretion regarding the personal information of other Users
Moderation of tone and absence of aggressiveness in shared annotations

A summarised, accessible version of these expectations is provided in the Settings › Community guidelines screen; in case of any difference in interpretation, these Terms prevail.

6.2 Prohibited content — zero tolerance

The Application enforces a zero-tolerance policy on the following content, which is strictly prohibited and will result in the removal of the content and, depending on severity, sanctions up to suspension or definitive deletion of the account:

Content unlawful under applicable law, including child sexual abuse material, glorification of terrorism, incitement to racial or religious hatred, attacks on human dignity
Defamatory, abusive, harassing, threatening or intimidating content
Discriminatory content (race, sex, sexual orientation, disability, religion, political opinion)
Pornographic, obscene, shocking or inappropriate content
Content manifestly insulting to the Catholic faith, its faithful or its ministers (e.g., mocking content aimed at disparaging the faith), or doctrinal content manifestly opposed to the Magisterium of the Church for the purpose of misleading the faithful
Unauthorised commercial, advertising or promotional content
Spam, repetitive or manifestly automated content
Content infringing the rights of others (intellectual property, privacy, image rights)
Impersonation of a person, an ecclesial institution or the Church
Attempted fraud, social engineering, or technical exploitation of the Application
Content promoting illegal, violent or dangerous activities for oneself or others

6.3 Ownership of user content

You retain full intellectual property ownership of the annotations, voice notes, highlights and collections you create in the Application. You are solely responsible for their content.

6.4 Licence granted to the Publisher

By publishing content with 'friends' or 'public' visibility (excluding strictly private content), you grant the Publisher, for the duration of your account and of the publication of your content on the Application:

A non-exclusive, free, worldwide licence, without sublicensing rights (except for the technical distribution strictly necessary to the service)
For the sole purposes of storage, indexing, display, distribution of this content in the Application, within the limits of the visibility you have chosen
For the period during which the content is published
Non-transferable, except in case of assignment of the contract in accordance with § 17.3; in that event, the licence is transferred to the assignee under the same conditions, without prejudice to your right to terminate immediately.

This licence terminates automatically upon deletion of the content by you, upon deletion of your account, or upon any moderation measure resulting in removal of the content.

This licence is strictly limited to operation of the Application: we will never use your content for commercial, advertising or promotional purposes outside the Application without your express prior consent.

6.5 User liability

You are responsible for the content you publish on the Application. Within the limit of any gross or wilful misconduct you may commit, and without prejudice to mandatory consumer protection provisions applicable in your country of residence, you indemnify the Publisher against any claim or action by third parties based on content you have published in breach of these Terms.

7. Moderation and reporting mechanisms

7.1 Content reporting

In accordance with Article 16 of the DSA, you may at any time report content that you consider unlawful or contrary to these Terms. The 'Report' button is accessible directly on the card of each published annotation.

The reporting form allows you to indicate:

The reason for the report (categorisation among the provided reasons)
A free-form description if necessary
Your identifier (for follow-up and possible recourse)

7.2 User blocking

You may block another User at any time from their profile. This action:

Prevents you from seeing their content in your feeds
Prevents them from seeing your content
Cancels any friendship or subscription relationship between you

7.3 Handling of reports

The Publisher undertakes to examine each report without undue delay, generally within 24 hours and at the latest within 72 hours of receipt, in accordance with the diligence requirement set out in Apple App Review Guidelines 1.2 and Article 16 DSA ('without undue delay').

Possible measures, depending on severity, are:

No action if the report is unfounded
Warning addressed to the User who published the content
Masking or removal of the disputed content
Temporary account suspension
Definitive account deletion in case of serious or repeated violation

7.4 Statement of reasons and recourse

In accordance with Article 17 of the DSA, when a moderation decision is taken against one of your content items or your account, you receive a reasoned notification indicating:

The nature of the decision (removal, masking, suspension, deletion)
The precise reasons (Terms clause violated, content reproached)
The recourse available to you

Internal recourse: you may challenge the decision by email to scriptioorg@gmail.com within 30 days of notification. The Publisher undertakes to re-examine the decision and to respond within a reasonable time, generally within 14 days.

External recourse: you retain the right to seise a competent court (see § 15) or the competent supervisory authorities.

7.5 Account suspension by the Publisher

The Publisher may suspend or delete an account in the following cases:

Violation of the rules of conduct (§ 6)
Abusive or harassing reported behaviour
Fraudulent use of the Application
Attempt to circumvent a previous suspension
Repeated failure to comply with moderation decisions

Any measure is notified to the concerned User with reasons and recourse.

8. Intellectual property

8.1 Biblical texts — public domain

The Application offers several Bible translations at the User's choice, all in the public domain. The active translation is set in Settings › Bible.

First translation: the Crampon 1923 Bible, translated by Abbé Augustin Crampon (1826-1894), in its revised single-volume edition of 1923 (Catholic canon, 73 books). Transcription source: Wikisource and Internet Archive. The work entered the public domain on 1 January 1965.

Second translation: the Louis Segond 1910 Bible, translated by Louis Segond (1810-1885), in its revised 1910 edition (Protestant canon, 66 books). Transcription source: eBible.org (USFX format, explicitly declared Public Domain status).

Third translation: the Douay-Rheims Bible in its revision by Bishop Richard Challoner (1749-1752), an English Catholic translation made from the Latin Vulgate (Catholic canon, 73 books). Transcription source: the “douayrheims” dataset from getbible.net, distributed in the public domain.

Fourth translation: the Torres Amat 1825 Bible, a Spanish Catholic translation made from the Latin Vulgate by Bishop Félix Torres Amat (died 1847, Catholic canon). Transcription source: the Biblia Torres Amat text published by bibliatodo.com, in the public domain. The deuterocanonical books are not yet included (66 books available).

Fifth translation: the Figueiredo Bible, a Portuguese Catholic translation made from the Latin Vulgate by Fr. António Pereira de Figueiredo (died 1797, full Catholic canon, 73 books, deuterocanonicals included). Transcription source: the digitisation of the 1950 edition available on Internet Archive, in the public domain (only the scriptural text is reproduced).

Sixth translation: the Martini Bible, an Italian Catholic translation made from the Latin Vulgate by Abp. Antonio Martini (died 1809, full Catholic canon, 73 books, deuterocanonicals included). The verse text comes from the Martini edition (1769-1781). Transcription source: the digital edition of the Martini Bible available online, in the public domain (only the scriptural text is reproduced).

Seventh translation: the Allioli-Arndt 1914 Bible, a German Catholic translation made from the Latin Vulgate by Joseph Franz von Allioli (died 1873), revised by Fr. Augustin Arndt S.J. (died 1912), 6th Pustet edition (Regensburg/Rome, 1914, with the approval of the Holy See, full Catholic canon, 73 books, deuterocanonicals included). Transcription source: digital edition of the Allioli-Arndt Bible, in the public domain.

Eighth translation: the Wujek Bible, the Polish Catholic translation of the Clementine Vulgate made by the Jesuit Jakub Wujek (died 1597) and published in full in 1599, full Catholic canon, 73 books, deuterocanonicals included. Transcription sources: the protocanonical books and the New Testament come from the 1923 edition (British and Foreign Bible Society), transcribed on Wikiźródła; the seven deuterocanonical books come from the original 1599 edition, digitised by biblia.info.pl, in the public domain.

Ninth translation: the Clementine Vulgate, the Catholic Church's reference Latin edition (typical edition promulgated in 1592 under Clement VIII, corrected reprints of 1593 and 1598), full Catholic canon, 73 books, deuterocanonicals included; the Clementine appendix (Prayer of Manasseh, 3 and 4 Esdras), outside the canon in the edition itself, is not included. All nine works are in the public domain pursuant to:

Article 29 paragraph 2 of the Swiss Federal Copyright Act (LDA), providing for protection limited to 70 years after the author's death
Article L. 123-1 of the French Intellectual Property Code, providing for protection limited to 70 years after the author's death
The Berne Convention for the Protection of Literary and Artistic Works

8.2 Brand, logo, source code and design

The 'Scriptio' brand, logo, icon, graphical interface, source code, design, illustrations, original editorial content and structured database of the Application are the exclusive property of the Publisher (or his rightsholders).

Any reproduction, representation, modification, translation, adaptation, distribution, making available or exploitation, partial or total, by any means whatsoever, is strictly prohibited without the Publisher's prior written authorisation.

8.3 Databases

The structuring of the Crampon 1923, Louis Segond 1910, Douay-Rheims (Challoner), Torres Amat 1825, Figueiredo, Martini, Allioli-Arndt 1914 and Wujek Bibles in the form of a JSON database (division into books, chapters, verses, metadata, and versification mapping tables between the translations) constitutes a protected database within the meaning of Directive 96/9/EC and Article 5 LDA. This structuring is the property of the Publisher, independently of the free nature of the underlying texts.

8.4 Third-party trademarks

All third-party trademarks mentioned in the Application (Apple, Google, Supabase, etc.) remain the property of their respective holders.

9. Privacy and personal data

The processing of personal data is governed by the dedicated Privacy Policy, compliant with the GDPR, FADP, DSA and COPPA / CCPA requirements for users concerned.

The Privacy Policy forms an integral part of these Terms. You may consult it at any time from the Application (Settings › Privacy Policy) or at https://scriptio.org/privacy.

10. Push notifications

The Application may send you push notifications where you have consented, for the following uses:

Verse of the day or daily reading reminder
Friendship request received
New annotation published by a friend or a profile you subscribe to
Amen received on one of your annotations
Administrative message from the Publisher (important information, update of conditions)

You may disable at any time all or part of these notifications from Settings › Notifications, without affecting the general operation of the Application.

11. Spiritual notice

Scriptio is a tool for reading and sharing. Annotations, teachings and commentaries published by Users, including those holding the verified badge, engage only their respective authors. The Publisher cannot be held responsible for the doctrinal content of annotations.

The Application does not replace:

The spiritual accompaniment of a priest, confessor or director of conscience
The Magisterium of the Catholic Church
Academic theological formation
Participation in sacramental life

For any important doctrinal or spiritual question, the User is invited to refer to the Magisterium of the Catholic Church (Catechism of the Catholic Church, encyclicals, apostolic exhortations, conciliar texts) and to consult a member of the clergy directly.

12. Application updates

The Application may be updated regularly (fixes, new features, security updates, biblical content evolution). Some updates may be necessary to continue using the Application.

Updates are distributed via the App Store and Google Play according to the usual modalities of these platforms.

13. Warranties and limitation of liability

13.1 'As is' provision

The Application is provided 'as is' and 'as available', without express or implied warranty other than those imposed by law. The Publisher does not warrant:

The total absence of errors, bugs or service interruptions
The truthfulness, accuracy or doctrinal conformity of content published by Users
The perfect suitability of the Application for a particular use
Uninterrupted availability or performance at any specific level

13.2 Limitation of liability

To the fullest extent permitted by applicable law, the Publisher's liability shall not be engaged for:

Indirect, incidental, consequential damages resulting from the use or impossibility of using the Application
Damages resulting from content published by other Users
Damages resulting from the failure of a third-party provider (Apple, Google, Supabase, telecommunications operator, etc.), without prejudice to mandatory provisions, in particular Article 82 GDPR on the joint liability of the controller and its processors
Data loss resulting from the User's misuse of the Application
The consequences of force majeure events within the meaning of Article 119 of the Swiss Code of Obligations

To the fullest extent permitted by applicable law, and without prejudice to § 13.3, the Publisher's total and cumulative liability for all direct damages resulting from the use of the Application is capped at 100 Swiss francs (CHF) per claim and 1,000 Swiss francs (CHF) in aggregate over twelve rolling months.

13.3 Preservation of mandatory rights

No clause of these Terms shall limit or exclude the rights of Users recognised as mandatory by the law of their country of residence, in particular:

The Publisher's liability in case of bodily injury or death resulting from his fault
The Publisher's liability in case of wilful misconduct or gross negligence
The mandatory protections applicable to consumers in their country of residence

14. Account deletion

14.1 Deletion at your request

You may delete your account at any time from Settings › Delete my account. This functionality complies with the Apple App Review Guidelines 5.1.1 (v) requirement for an in-app account deletion accessible directly from the Application.

The deletion of your account results in:

The immediate anonymisation of your data in the database
The definitive deletion within 30 days (grace period allowing cancellation by email to scriptioorg@gmail.com)
The deletion of your private annotations and voice notes
The deletion of the public annotations you have published
The deletion of all your friendship and subscription relationships
The immediate revocation of Application access

Certain data may be retained beyond the 30-day period only insofar as strictly necessary to comply with legal obligations (e.g. administrative logs in case of ongoing investigation) or to defend rights in court.

14.2 Deletion by the Publisher

The Publisher may delete an account in the following cases:

Serious or repeated violation of these Terms
Fraud or attempted fraud
Moderation decision following a report
Prolonged inactivity of more than 5 years (with email prior notice)

15. Applicable law and jurisdiction

15.1 Applicable law

These Terms are governed by Swiss law, to the exclusion of:

Conflict-of-laws rules
The Vienna Convention of 11 April 1980 on contracts for the international sale of goods

15.2 Competent jurisdiction

For any dispute relating to the use of the Application, the ordinary courts of the canton of Vaud (Switzerland) shall have jurisdiction.

This jurisdiction clause is however without prejudice to mandatory provisions applicable to Users with the status of consumer in their country of residence. In particular:

Consumers residing in the European Union retain the right to seise the courts of their habitual residence, in accordance with Articles 17 to 19 of Regulation (EU) No 1215/2012 (Brussels I bis)
Consumers residing in Switzerland retain the right to seise the court of their domicile, in accordance with Article 32 of the Swiss Code of Civil Procedure

15.3 Amicable resolution

Prior to any judicial action, the parties shall endeavour to settle amicably any dispute by email exchange within a reasonable time. The Publisher undertakes to examine any complaint received at scriptioorg@gmail.com within 30 days.

15.4 Severability clause

If any clause of these Terms is held null, illegal or unenforceable, in particular under Article 8 of the Swiss Federal Act against Unfair Competition (LCD) or any mandatory consumer-protection provision, that clause shall be deemed not written, without affecting the validity of the other clauses of these Terms.

16. Modifications to the Terms

The Publisher reserves the right to modify these Terms for legitimate reasons, in particular: technical or functional developments of the Application, evolution of the applicable legal framework (GDPR, FADP, DSA, Apple or Google requirements), doctrinal evolution of the project, addition, removal or replacement of a subprocessor, correction of typographical errors or incorrect references.

In case of substantial modification, you will be informed:

By push notification in the Application
By banner displayed at Application launch
At least 30 days before the effective date of the new version

Continued use of the Application beyond this 30-day period constitutes acceptance of the new terms. If you refuse the new terms, you may delete your account at any time from the Application without any consequence.

Previous versions of the Terms are retained and may be obtained on request to scriptioorg@gmail.com.

17. Miscellaneous provisions

17.1 Entire agreement

These Terms, together with the Privacy Policy and the Legal Notice, constitute the entire agreement between you and the Publisher with respect to the use of the Application. They prevail over any prior or contemporaneous agreement, oral or written, on the same subject.

17.2 No waiver

The fact that the Publisher does not, at any given moment, rely on one of the provisions of these Terms shall not be interpreted as a waiver to rely on it later.

17.3 Assignment

The Publisher may assign these Terms and all rights and obligations arising therefrom to any third party in case of reorganisation, transfer of business, or change in his legal status (formation of an association, company, foundation, etc.). You will be informed of any such assignment and retain the right to terminate your account on that occasion.
